Correct Conditions reviews information provided by clients and project teams and gives technical observations, risk comments and practical recommendations based on the available information at the time of review.

Our services are intended to support better decision-making. They do not remove the need for competent project design, installation, commissioning, operation, statutory compliance or professional judgement by the responsible duty holders.

Unless clearly agreed in a written scope, our review should be treated as advisory and not as a complete approval, certification, validation or sign-off of the system.

We may comment on

4. What our review does not automatically include

Full design responsibility

We do not become the mechanical designer, electrical designer, controls designer or responsible engineer unless this is expressly agreed in writing.

Statutory approval

Our comments do not replace building control, planning, CDM, health and safety, fire, electrical, pressure systems, F-Gas or other statutory duties.

Installation sign-off

We do not certify that an installation is complete, compliant, safe or defect-free unless a specific inspection and sign-off scope has been agreed.

Commissioning certification

We may review commissioning information, but we do not replace the commissioning engineer or manufacturer commissioning requirements.

Performance guarantee

We may provide improvement recommendations, but we do not guarantee COP, energy savings, carbon savings, runtime, reliability or fault reduction unless agreed separately in writing.

Legal or contractual advice

We do not provide legal, contractual, insurance, claims, dispute or expert witness advice unless this is separately agreed in a formal scope.

5. Client responsibilities

Clients and project teams remain responsible for ensuring that designs, installations, commissioning, operation, maintenance and statutory compliance are carried out by competent persons and in accordance with applicable laws, regulations, standards, contracts and manufacturer requirements.

The client is responsible for providing accurate, complete and up-to-date information where it is needed for a review.

If information is missing, incorrect, outdated or incomplete, our observations and recommendations may be limited.

6. Site visits and safety

Where a site visit is agreed, the client or site operator remains responsible for site access, inductions, permits, supervision, safe working arrangements and ensuring that the site is safe to access.

Correct Conditions may decline, pause or stop a site visit if access is unsafe, unsuitable, restricted or outside the agreed scope.

A site visit does not automatically constitute a full condition survey, compliance inspection, safety inspection, commissioning verification or defect inspection unless this has been agreed in writing.

7. Reports, recommendations and limitations

Reports and written comments are prepared using the information available at the time. They may include assumptions, limitations, exclusions and recommendations for further checks.

Any recommendations should be reviewed by the responsible project designer, contractor, installer, manufacturer, operator or other competent party before implementation.

Correct Conditions is not responsible for how recommendations are interpreted, implemented or modified by others unless we have been formally appointed to manage that specific work.

8. Monitoring and PIP

Monitoring, trend review, ConditionScore, ConditionView, ConditionPod and PIP-related services are intended to support performance visibility and improvement.

Monitoring information may indicate potential issues, but it should not be treated as a complete safety system, alarm system, statutory compliance system or replacement for normal operation and maintenance.

Data quality depends on sensor accuracy, data availability, BMS configuration, communication reliability and site conditions.

9. Confidentiality and project information

We treat client project information as confidential unless it is already public, independently known to us, required to be disclosed by law, or agreed otherwise.

Clients should only provide documents and information they are authorised to share with us. Where third-party or client-confidential information is provided, the sender is responsible for ensuring they have permission to share it.

AI and data-use caution

Confidential client documents, personal information or commercially sensitive project information should not be uploaded into AI tools unless permitted by the client, contract and internal data-use policy.

Where AI-assisted workflows are used, information should be minimised, redacted or anonymised where practical.

10. Intellectual property

Website content, reports, templates, diagrams, wording, methods, frameworks, ConditionScore, ConditionView, ConditionPod, PIP materials and other Correct Conditions materials remain the intellectual property of Correct Conditions unless agreed otherwise in writing.

Clients may use reports and deliverables for the agreed project purpose. They must not copy, resell, publish, adapt or use our materials for unrelated projects or commercial purposes without written permission.

11. Fees, proposals and payment

Any fees, scope, deliverables, timescales and payment terms will be confirmed in a proposal, quotation, engagement letter, purchase order, contract or other written agreement.

Unless agreed otherwise, work will not start until the scope, fee and commercial terms have been accepted.

Additional work, meetings, data review, site visits, revisions or out-of-scope support may be chargeable.

12. Changes, delays and cancellation

Project timescales may depend on information being provided promptly, access being available and the agreed scope remaining unchanged.

If a client delays, changes or cancels work after instruction, Correct Conditions may charge for work already carried out, committed time, expenses and any agreed cancellation terms.

13. Limitation of liability

Correct Conditions will use reasonable skill and care when providing services. However, our liability is limited to the scope, assumptions, exclusions and commercial terms agreed in writing for the relevant service.

To the fullest extent permitted by law, Correct Conditions is not liable for indirect losses, loss of profit, loss of revenue, loss of opportunity, business interruption, consequential losses or losses arising from reliance on incomplete, inaccurate or outdated information.

Nothing in these terms excludes or limits liability where it would be unlawful to do so.
